1. Mr. Yogesh Pant and Mr. Kulwant Singh,
learned counsel for the applicant.
2. Mr. Siddhartha Bisht, learned A.G.A. with Mr. Himanshu Sain, learned Brief Holder for the State.
3. The present applicant ‘Jaspal Singh @ Monu Singh’ S/o Jeet Singh is praying for regular bail in relation to First Information Report dated 03.04.2025 bearing FIR No. 132 of 2025 P.S. Kashipur, District Udham Singh Nagar, which was lodged against the unknown person for the offence punishable under Section 140(3) of BNS,
2023. After completion of the investigation the applicant has been chargesheeted for the offence punishable under Sections 75(2), 87 and 115(2) of BNS, 2023.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and furthermore the FIR has been lodged against the unknown person, but before filing the chargesheet no TIP was done.

Apart from this, he submits that the applicant has no previous criminal history and the applicant is languishing in jail since 03.04.2025 and as the chargesheet has already been filed and as such there is no need of custodial interrogation of the present applicant. He further submits that in the chargesheet two persons have been chargesheeted and the other one was juvenile and already granted bail.
6. On the other side, learned A.G.A. submits that after collecting all credible evidences the chargesheet has been filed and submits this is a case of attempt of rape. Apart from this, he has not disputed that the chargesheet has already been filed, therefore, there is no need of custodial interrogation of the present applicant.
7. After hearing the arguments of learned counsel for the parties and further taking into

consideration that the chargesheet has already been filed and as such there is no need of custodial interrogation of the present applicant and furthermore the applicant has no previous criminal history, this court is of the view that the applicant deserves for bail.
8. Accordingly, without expressing any opinion on the merit of the case the bail application is allowed.
9. Let the applicant ‘Jaspal Singh @ Monu’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
10. It is made clear that after being released on bail the applicant will not make any attempt to threaten any of the witnesses and will cooperate with the ongoing trial, failing which, the concerned Magistrate will take immediate action against the applicant including cancellation of bail.
