Learned AGA is present on behalf of the State. 2. This criminal appeal was filed by the appellant Raghav Prasad Tripathi against the order dated 1.1.1985. By means of said impugned order, an application under Section 340 Cr.P.C. was rejected by the learned trial court. 3. A report regarding living status of the parties was summoned through C.J.M. Gorakhpur. It has been reported by learned C.J.M. Gorakhpur that appellant Raghav Prasad Tripathi, as well as respondent no. 3-Awadh Narain and respondent no. 4-Param Hans Singh have died. 4. Considering that the appellant as well as the respondent no. 3 and 4 have died, there is no fruitful purpose to keep this criminal appeal pending. 5. Accordingly, this criminal appeal is dismissed.
