Order 06/02/2025 This writ petition is filed seeking a direction to the learned Rent Tribunal, Jaipur Metropolitan-II, Jaipur for expeditious disposal of the eviction petition No.289/2018: Smt. Gayatri Devi Vs. Smt. Raju Devi and others.
Learned counsel for the petitioner submits that the aforesaid eviction application filed by her on the grounds, inter alia, reasonable and bonafide necessity is pending since April 2018 and despite appearance of the applicant’s witnesses about seventeen times, they have not been cross-examined yet. He, therefore, prays that the learned Rent Tribunal be directed for its expeditious disposal. Heard. Considered.
[2025:RJ-JP:5250] (2 of 2) [CW-2004/2025] In view of Constitution Bench judgment in the case of High Court Bar Association, Allahabad Vs. State of U.P. and others: Criminal Appeal No.3589/2023 dated 29.02.2024, this Court does not deem it just and proper to issue any direction to the learned Rent Tribunal for expeditious disposal in absence of any data as to the pending matters with it and/or details of daily docket. However, after perusal of the order-sheet submitted by the petitioner, this Court deems it just and proper to request the learned Rent Tribunal to conclude the cross-examination of the applicant and her witnesses at earliest. With this observation, this writ petition is disposed of.
