At this stage, learned counsel for the petitioner submits that he will file application for condonation of delay, however, a direction be issued to respondent No.1 to consider and take decision on appeal at the earliest. 3. In view of submissions of learned counsel for the respective parties, this writ petition at this stage is disposed off permitting the petitioner to submit application for condonation of delay in filing Second Appeal before respondent No.1 and if such application is filed, concerned appellate authority shall consider and decide the same in accordance with law, expeditiously.
