1. The present appeal under Section 21 of the National Investigation Agency (NIA) Act, 2008, arises from an order dated 17th September, 2021, passed by the Special Judge Designated under NIA, Srinagar [“the trial Court”], whereby bail was granted to the respondent in case FIR No. 4/2019, under Sections 13/18/19/20/38 of the Unlawful Activities (Prevention) Act, Sections 307/212/120-B RPC, 7/25, 7/27 IA Act etc. which is pending adjudication before the trial Court.
2. This appeal has been pending consideration before this Court since the year 2022. At the time of filing of the appeal, the prosecution had examined 24 out of 29 witnesses. It has been MIR ARIF MANZOOR I attest to the accuracy and authenticity of this document 04.06.25
brought to our notice by the learned counsel appearing for the appellant that, during the pendency of the appeal, three more witnesses have been examined, and only two witnesses are yet to be examined.
3. In view of the aforesaid status of the trial and keeping in view pendency of this appeal for the last more than three years, we are of the considered opinion that considering the appeal at this stage and withdrawing the order of granting of bail passed by the trial Court in favour of the respondent would be highly uncalled for. As the trial is at the verge of completion, we request the learned trial Court to expedite the recording of the remaining witnesses and bring the trial to its logical end expeditiously.
4. With the aforesaid observations, this appeal is disposed of.
