In compliance of the Court’s order dated 12.11.2025, the notice with respect to the present bail application has been served to the victim on 18.11.2025 and when the matter is taken for hearing today, none has appeared on behalf of the victim to contest the matter. Hence, this Court proceeds to hear the matter finally. 2. The applicant has preferred this anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of Anticipatory Bail, apprehending his arrest in connection with Crime No. 188/2025, registered at Police Station – Patthalgaon, District – Jashpur (C.G.) for alleged commission of offence punishable under Sections 70(2) and 87 of BNS and Section 6 of Protection of Children from Sexual Offences (POCSO) Act. As per the prosecution story in brief, is that on 10.01.2025 the applicant and one another juvenile accused taken the minor girl and committed sexual intercourse with her alternatively, therefore crime as mentioned above has been registered, reluctantly the victim got pregnant. Hence, this application. 4. The learned counsel for the applicant has argued that the applicant is completely innocent and further submitted that the co-accused who was a juvenile has already been enlarged on bail in the present case. Therefore applicant is also entitle for grant of bail. 5. On the other hand, learned State counsel opposed the prayer for grant of anticipatory bail and submitted that as per the statement of the victim recorded under Section 183 of BNSS, it transpires that the victim is a minor girl aged about 15 years, and she has categorically stated that it was the present applicant and the co-accused who is juvenile, who had committed rape on her, due to which she became pregnant, and so far as the DNA report is concerned, the same is still awaited.
Therefore, the present anticipatory bail application of the applicant is liable to be rejected. 6. I have heard learned counsel for the parties and perused the material available on record. 7. In view of the incriminating facts and circumstances emerging from the case diary, and as per the statement of the victim recorded under Section 183 of BNSS, it transpires that the victim is a minor girl aged about 15 years, and she has categorically stated that it was the present
3 applicant and the co-accused who is juvenile, who had committed rape on her, due to which she became pregnant, and so far as the DNA report is concerned, the same is still awaited, hence, this Court is of the opinion that the applicant is not entitled to be granted anticipatory bail in this case. 8. Accordingly, the Anticipatory Bail application of the applicant – Sunil Puri, filed under Section 482 of the BNSS, 2023 in connection with Crime No. 188/2025, registered at Police Station – Patthalgaon, District – Jashpur (C.G.) for alleged commission of offence punishable under Sections 70(2) and 87 of BNS and Section 6 of POCSO Act, is rejected.
