Neutral Citation No. - 2025:AHC:85282 Court No. - 74 Case :- APPLICATION U/S 528 BNSS No. - 18312 of 2025 Applicant :- Prakash Narayan Dwivedi Opposite Party :- State Of U.P. And 3 Others Counsel for Applicant :- Vinay Kumar Mishra Counsel for Opposite Party :- G.A. Hon'ble Saurabh Srivastava,J. 1. Heard Sri Vinay Kumar Mishra, learned counsel for applicant, Sri Gaurav Pratap Singh, Advocate holding brief of Sri J.K. Upadhyay, learned counsel for Electricity Department and learned A.G.A. for State. 2. At the very outset, learned counsel for Electricity Department sought the attention of Court over order dated 07.03.2025 passed by co-ordinate Bench of this Court in Criminal Misc. Anticipatory Bail Application u/s 482 BNSS No.1902 of 2025 (Prakash Narayan Dwivedi vs. State of U.P. and Another), through which three weeks' time has been extended in favour of applicant for surrendering before learned court concerned. 3. It is fairly admitted by learned counsel for applicant that order dated 07.03.2025 has not been complied with. It is further submitted by learned counsel for applicant that he is ready to pay the entire dues whatsoever as due to be paid before Electricity Department, but this arguments has not been sustainable in absence of strict compliance of order dated 07.03.2025 and as such prayer mentioned in the application cannot be exceeded unless the applicant surrender himself in compliance of order dated 07.03.2025. 4. The instant application stands dismissed accordingly. 5. However, it is made clear that three weeks' further is hereby extended in favour of applicant to surrender before learned court concerned.
