(iii) Any other relief or relief (s) which this Hon’ble Court may deem fit or proper in the facts and circumstances of the case.” 2. Learned counsel for respondents submits that though the award has been passed by the Competent Authority under the Land Acquisition Act, however, the award is under challenge before the Arbitrator U/s. 3 G (5) of the National Highways Act, 1956, therefore, the amount is not disbursed. He contended that the amount towards compensation against acquisition of land of petitioners will be disbursed after conclusion of the proceedings pending before the Arbitrator. 3. At this stage, learned counsel for petitioners submits that this petition may be disposed of by directing the Arbitrator to conclude the proceeding at the earliest. 4. Mr. Wankhede, learned counsel appearing on behalf of respondents No.5 submits that it is petitioners, who earlier not appeared before the Arbitrator after receipt of notice and now after appearing reply to the claim application has not been submitted. 5. In the aforementioned facts of the case, where petitioners themselves appears to be in default in not filing the proceedings within specified time, I do not find any good ground to accept the prayer of learned counsel for petitioner. 5 6.
