Learned counsel appearing for the appellant fairly submits that the application filed by the present appellant, who was the defendant before the learned Trial Court, under Order VII Rule 11 CPC read with Section 151 CPC was dismissed. However, in Civil Review Petition No. 10/2025, vide order dated 04.12.2025, the said application was allowed and the plaint was rejected. Learned counsel submits that, though an SLP has been filed against the said order, there is no stay operating thereon. 3. In view of the fact that the underlying plaint has been rejected and there is no subsisting plaint, the interim orders do not survive. 4. Accordingly, learned counsel for the appellant seeks leave to withdraw the present appeal, with liberty to revive the same in the event the said plaint is restored. 5.
