For issuance of an appropriate writ /writs/order/orders, direction/ directions commanding upon the respondents concern to quash the order dated 09.11.2022 passed in confiscation (ANNEXURE-2) Case No. 19/2019 whereby and whereunder the Learned Divisional Forest Officer (Latehar) has been pleased to confiscate the Mahindra Tractor bearing Registration No. JH19B 3320 Chasis No. MBNAAADAPJR001173, Engine No.RJD2DBN5706 along with trailer upon loaded with 100CFT stone Bolder. The order dated 25.04.2023 passed in confiscation Appeal No. 127/2022 by Learned Deputy Commissioner, Latehar, whereby the appeal preferred by the petitioner has been dismissed, directing the concerned respondent to forthwith release the Mahindra Tractor along with its trailer of the petitioner bearing Registration No. JH19B-3320 Chasis No. MBNAAADAPJR001173, Engine No. RJD2DBN5706. 2. An objection has been raised that there is an alternative remedy by way of revision before the concerned Secretary, and as such learned counsel for the petitioner seeks permission to withdraw the present writ petition with a liberty to approach the revisional authority. 3. Permission is accorded. 4. Accordingly, the present writ petition stands disposed of giving liberty to the petitioner to approach the revisional authority. 5. If any such application is filed within two weeks, the revisional authority is directed to decide the same within six weeks thereafter. (Rajesh Kumar, J.) Shahid/
