This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 255/2016 registered at Police Station Kotwali, District Raigarh (C.G.), for the offence punishable under Sections 409, 420, 120(B) of the Indian Penal Code and Section 13(2) and 13(1)(d) of the Prevention of Corruption Act. 2. As per the prosecution story, on 06.06.2013, a tender was issued for the purchase of 25 containers (dustbins) of 2.5 cubic meters and other items by the co-accused. The tender was allegedly issued without the approval of the Government and the Mayor-in-Council, and no publication of the ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.12.05 18:28:58 +0530 2 tender was made in any newspaper or circulated throughout the State. It is further alleged that the applicant was working as a Fire OfÏcer in the Municipal Corporation along with the other accused and was also holding the additional charge of accounts. The applicant, by not deducting 2% VAT from a bill amounting to Rs. 37,610/-, allegedly caused a loss to the State exchequer. Thereafter, an FIR was lodged, and a charge-sheet has been filed against the co-accused persons. 3. Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the present case. He submits that the applicant was working as a Fire OfÏcer under the Municipal Corporation, Raigarh, and the deduction of 2% Commercial Tax was not within the domain of the present Applicant. It is an ofÏcial procedure, and even if the deduction has not been made, a separate forum is available under the Commercial Sales Tax Act. The deduction of 5% security amount was also not within the domain of the applicant. No criminality has been committed by the applicant, and only false allegations have been attributed to him. He further submits that there are a total of four crimes registered against the present applicant, out of which the applicant has already been granted anticipatory bail in two crimes, vide MCRC(A) No. 533/2016 in Crime No. 248/2016 and MCRC (A) No. 535/2016 in Crime No. 247/2016. The applicant, being a Fire OfÏcer in the Municipal Corporation, Raigarh, is subject to departmental action for any enquiry conducted against him, which clearly shows that no offence has been committed by the applicant. Further, no departmental enquiry has been initiated against the present Applicant. The Applicant has also retired on 31.10.2025. He also submits that the applicant is already facing trial in Crime Nos. 248/2016 and 247/2016 and is continuously appearing before the learned trial Court. However, 3 the police authorities did not file the charge-sheet against the present applicant initially. Later, a supplementary charge-sheet was filed against him. He further submits that the co-accused have already been released on bail by this Court in M.Cr.C. No. 3979/2017, M.Cr.C. No. 3984/2017, M.Cr.C. No. 5483/2017, and M.Cr.C. No. 5486/2017. He submits that the applicant is suffering from several medical issues, including infections in both lungs, respiratory failure, impaired kidney function, and a skin infection on the leg. He is also of advanced age, i.e., 65 years, and has been languishing in jail since 11.11.2025. As the conclusion of the trial may take some time, he prays for the grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the applicant and submits that in the present case, the charge-sheet has been filed against the applicant as an absconder. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, including the fact that the present matter pertains to the year 2016, and further that the allegation against the applicant is that he was working as a Fire OfÏcer in the Municipal Corporation along with the other accused and was also holding the additional charge of accounts, and that by not deducting 2% VAT from a bill amounting to Rs. 37,610/-, he allegedly caused a loss to the State exchequer; and considering also that although the charge-sheet has been filed against the applicant as an absconder, he is an elderly person aged about 65 years, has been facing criminal trial since 2016, and has been languishing in jail since 11.11.2025 and further that the conclusion of the trial may take some time, this Court is of the view that the applicant is entitled to be released on bail in this case. 4 7.
