Neutral Citation No. - 2025:AHC:28433 Court No. - 10 Case :- WRIT - A No. - 21479 of 2019 Petitioner :- Tejram Singh Respondent :- State Of U P And 4 Others Counsel for Petitioner :- Dhananjay Kumar,Hakim Kumar Kushwaha,Kamlakar Pal Counsel for Respondent :- C.S.C.,Shishir Prakash Hon'ble Saurabh Shyam Shamshery,J. This writ petition was probably filed on a good cause i.e. the petitioner may be allowed to work up to 62 years, however, since no interim order was passed and this writ petition is now pending for lasts six years, the efficacy of prayer also got lost, however, the Court is of considered opinion that the prayer of petitioner as stated by Sri Kamlakar Pal, learned counsel for petitioner that due to pendency of this writ petition, his retiral benefits as legally permissible have not been considered and have not been paid, however, it could still be considered. Sri Shad Khan, Advocate holding brief of Sri Shishir Prakash, learned counsel for respondent Nos.2 to 4 submits that in absence of proper instruction, so far as above grievance is concerned, he is not able to assist the Court, however, he assures that the claim of pension, if permissible, will be considered including other retiral benefits and in case of any legal impediment, the same will be communicated to the petitioner. Accordingly, this writ petition is disposed of, taking note of assurance given by learned counsel for respondent Nos. 2 to 4. It is observed that in case petitioner constrains to approach this Court for similar relief, the Court may take a strict view against the concerned respondents. Order Date :- 28.2.2025 P.
