This intra court appeal is directed against judgment dated 12.04.2018 passed by learned Single Judge in WPSS No.814 of 2017. By the said judgment, petitioner’s claim, for regularization of his services on the post of Junior Assistant cum Data Entry Operator, was rejected. 4. Learned counsel for appellant submits that appellant was appointed as daily wager in the year 2005 and he has been serving continuously as Junior Engineer cum Data Entry Operator ever since then; since petitioner has served for almost 20 years to the satisfaction of all concerned authorities, therefore, judgment, impugned in this appeal, may be modified and the competent authority be directed to examine petitioner’s claim 2025:UHC:1899-DB for regularization as per applicable Rules. 5. Learned State Counsel fairly submits that he has no objection if judgment impugned is modified and the competent authority is directed to consider petitioner’s claim for regularization. 6. Accordingly, special appeal is allowed. The impugned judgment is set aside. The competent authority in Uttarakhand Public Works Department shall constitute a Regularization Committee as per Regularization Rules, framed by State Government. The Committee shall examine claim of the petitioner and all other persons, eligible for regularization and take decision. The final decision regarding regularization shall be taken by the competent authority within six months from date of receipt of this order. (Ashish Naithani, J.)
