The accused/applicants have moved this second bail application under Section 483 of BNSS, 2023 for releasing them on regular bail during trial in connection with Crime No. 04/2025 registered at Police Station - Sargaon, District – Mungeli (C.G.) for the offence punishable under Sections HEERA LAL SAHU Digitally signed by HEERA LAL SAHU Date: 2025.12.04 17:14:36 +0530 2 103(1), 109, 296, 115(2), 351(2), 3(5) of BNS, 2023 and Sections 25 and 27 of Arms Act. 2. As per the prosecution’s case, it is alleged against the applicants that on 13.01.2025, they along with one another, co-accused, namely Bhupendra Verma, committed assault by means of wooden stick, leather belt and knife on Abhay Sahu (complainant) and Karan Yadav (deceased) and due to the said assault, Karan Yadav died and Abhay Sahu sustained injuries. Based on this, offence has been registered against the present applicants. 3. Learned counsel for the applicants submits that the applicants have been falsely implicated in the present case. He further submits that injured eye witness Abhay Sahu (PW-2) has been examined before the trial Court and has not supported the case of the prosecution. He next submits that the applicants are in jail since 10.03.2025, and there is no likelihood of their case being decided in the near future; therefore, the present applicants may be released on bail. 4. On the other hand, learned counsel for the State opposes the bail application and submits that the injured eye witness, Abhay Sahu (PW-2) supported the case of the prosecution. The applicants along with one another, co- accused, committed the heinous offence of murder and 3 there is a seizure of wooden stick from applicant Devnarayan Verma and leather belt from applicant Umesh Kumar Verma and there is a named FIR against the applicants; therefore, at this stage, they may not be enlarged on bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the entire facts and circumstances of the case, particularly looking material available on record, the evidence collected by the prosecution against the applicants and the nature of crime, at this stage, I am not inclined to release the applicants on bail. Accordingly, the bail application filed under Section 483 of BNSS, 2023, is rejected. 7. However, considering the fact that the applicants are in jail since 10.03.2025, and only 13 witnesses out of 36 witnesses have been examined till date, the concerned trial Court is directed to expedite the trial and to ensure that the trial is concluded as expeditiously as possible preferably within a period 4 months from receipt of a copy of this order. 8.
