Bora, the learned counsel appearing for the petitioner as well as Mr. RR Kaushik, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner Smti Manalisha Baruah @ Putali Bhadra has prayed for releasing her on bail after she was arrested in Page No.# 2/2 connection with Dhakuakhana P.S. Case No. 36/2024. 3. In this case, the case diary was called for. 4. Today Mr. Kaushik submits that the case diary is yet to be received. 5. This Court is of the opinion that to consider the bail application of the petitioner, perusal of the case diary is not necessary. 6. In the FIR, it is alleged that the wife of the informant has committed suicide in her house and the petitioner and her husband floated a rumour that the deceased had relationship with another person. 7. The law regarding abetment of suicide is already well settled. If a person floats a rumour and that person commits suicide, nobody can be held guilty for that suicide. 8. The petitioner has already spent 40 days in custody. 9. I have considered the submissions made by the learned counsels of both sides. 10. Under the Given circumstances of the case, this Court is of the opinion that the petitioner does not deserve to be detained in custody. Her bail application is allowed. 11. It is hereby directed that the petitioner, Smti Manalisha Baruah @ Putali Bhadra, who was arrested in connection with Dhakuakhana P.S. Case No. 36/2024, shall be released on bail of ₹20,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dhakuakhana.
