Neutral Citation No. - 2025:AHC:90209 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5247 of 2025 Petitioner :- Ram Prakash Tyagi (Since Died) And 2 Others Respondent :- State Bank Of India And 2 Others Counsel for Petitioner :- Prem Chand Saroj Counsel for Respondent :- C.S.C.,Satish Chaturvedi Hon'ble Rohit Ranjan Agarwal,J.
1. Pursuant to the order dated 20.5.2025, learned counsel appearing for State Bank of India has placed before the Court the instructions, so received by him. According to the said instructions, the total outstanding amount against the petitioners is Rs. 1,10,43000/-.
2. Learned counsel appearing for the respondent bank informs the Court that for last 51 years not a single penny has been paid by the petitioners towards the loan taken by them.
3. On the last occasion, learned counsel for petitioners had submitted that petitioners are ready to pay the outstanding amount. However, on the matter being taken up today after knowing the outstanding amount petitioners' counsel submits that the amount already recovered after auctioning the mortgaged property be also considered and appeal filed by petitioners should be decided first.
4. This Court finds that the amount, which was obtained by the bank after auction took place, has been adjusted into the loan account, maintained by the respondent bank. As petitioners, on previous occasion, were ready to deposit the outstanding amount but today they have taken u-turn and there is huge liability upon them to pay Rs. 1,10,43000/- to the respondent bank, I am of the view that the order impugned needs no interference by this Court.
5. Writ petition fails and dismissed, accordingly. Order Date :- 27.5.2025 Shekhar Digitally signed by :- SHASHI SHEKHAR PANDEY High Court of Judicature at Allahabad
