Respondents proceeded ex-parte vide order dated 26.05.2025. OMP No.850 of 2024 Heard. There is delay in re-filing the appeal after removing the objections, hence, this application has been moved for condoning the delay in re-filing the appeal. The objections raised pertain to the procedural aspects of filing the arbitration appeal and do not affect the appeal as such. The delay in re-filing the appeal after removing the objections has been explained in the application. Accordingly, the application for condoning the delay in re-filing of the appeal after removing objections is allowed. The application stands disposed of. OMP(M) No.147 of 2024 There is no appearance for the respondents, who otherwise have already been proceeded against ex-parte. No application for setting aside the ex-parte order dated 26.05.2025 has been moved till date by the respondents. This leads to the inference that the respondents are not interested to oppose the prayer for condoning the delay made in this application. I have heard learned counsel for the applicant/ appellant and considered the application, which is duly supported by an affidavit. The applicant/appellant has cogently explained the delay in institution of the appeal. Accordingly, for the reasons stated in the application and the submissions made by learned vice counsel for the applicant/appellant, delay in filing the appeal is condoned. The application to stand disposed of. Arb. Appeal No. of 2025 Be registered. List on 05.06.2025. OMP No.1017 of 2024 This application was disposed of on 25.09.2024, permitting the applicant/appellant to deposit the awarded amount alongwith upto date interest. It appears that the amount has till date not been deposited. Learned vice counsel appearing for the applicant/ appellant prays for and is allowed a week’s time to take instructions in the matter.
