ORDER ON BOARD 08 /12/2025
1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to issue appropriate writ directing the respondents to conclude the proceedings of allotment of land to the petitioner upon the application dated 15.05.2023 as per the provisions of Revenue book circular and it ancillary notifications/amendments, in a time bound manner. 10.2 Any other relief, which this Hon’ble Court, may deem fit and proper, in the facts and circumstance of the case.”

2. Learned counsel for the petitioner submits that the petitioner is an ex- service man, retired from the post of Havaldar from Indian Army, Corps of Signals. Petitioner according to the policy formulated by the State Government has submitted an application for allotment of 05 acres of non-irrigated land or 2.5 acres of the irrigated land. The application is filed on 15.05.2023, however, since then, no proper progress in the proceedings initiated by the Respondents No. 2/Collector and therefore, direction be issued to the Respondent No. 2 to conclude the proceedings initiated on the application submitted by the petitioner at the earliest within specified time.

On the other hand, learned counsel for the Respondents/State submits that as the petitioner is not pressing this writ petition on merits and is only seeking a direction to the Respondent No. 2 to consider and decide the pending application within specified time, he is having no objection to the limited prayer.
4. I have heard learned counsel for the parties and also perused the documents placed on record.

The application submitted by the petitioner dated 15.05.2023 (Annexure P/1) have been forwarded by Commissioner, Bilaspur Division vide memo dated 17.06.2025 wherein, the complaints made by the complainants including the complaint raised by petitioner was forwarded to the Respondent No. 2/Collector for its consideration, from which, it is appearing that the application submitted by the petitioner is still pending
consideration before the Respondent No. 2/Collector.

In view of the aforementioned facts of the case, submission of counsel for the parties, instead of keeping this writ petition pending seeking reply from the respondent authorities, I find it appropriate to dispose of this writ petition directing the Respondent No. 2/Collector to consider and take
3 decision on the application submitted by the petitioner in accordance with law, expeditiously, preferably within an outer limit of 04 months from the date of receipt of the order.
7. With the aforesaid observation and directions, this writ petition stands
