ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE S.R. KRISHNA KUMAR)
In this petitioner seeks the following reliefs:
WHEREFORE, the complainant most humbly prays that this Hon’ble Court be pleased to allow the contempt petition and punish the Accused in accordance with law and as per the provisions of the contempt of court Act for having disobeyed the order dated 09.12.2023 passed in W.P.No.112629/2014 passed by this Hon’ble Court vide ANNEXURE-J in the interest of justice and equity.
2. When the matter came up for hearing before this Court on 07.08.2025, the following order was passed:
“ Smt. Kareemunnisa Syed, Joint Director of Department of Collegiate Education, Dharwad Region, Dharwad, is present before the Court. Learned Additional Government Advocate has filed a memo along with communication dated 11.07.2025 which indicates that the respondents have agreed to pay Rs.76,776/- to the complainant.

Learned Additional Government Advocate on instructions submitted that the process of making payment is underway and they would ensure that the payment is made as per the communication. In view of the said submission, relist this petition on 28.08.2025.”
3. In pursuance of the said order, learned AGA has filed a memo, which reads as under:
MEMO
“ The Respondents / accused in the above case respectfully submits as under:
That in the above said Contempt Petition was filed by the complainant against the accused for disobedience of the order dated 09.12.2023 passed in W.P.No.112629/2014 by the learned Single Judge.
It is submitted that, the complainant filed a Writ Petition No.112629/2014 seeking mandamus to make payment of interest filed representation dated
20.01.2014. The said matter was listed before the Lok-Aadhalath on 09.12.2023 and joint memo was filed. Pursuant to

which the order was passed directing the Respondents to consider the representation dated 20.01.2014 in accordance with law within a period of 3 months.
Now the representation of the complainant was considered and the Joint Director, Collegiate Education, Dharwad
directed the college authorities to remit the payment to the Account of the complainant. As per the direction the college authorities have remitted the said amount to the account of complainant on
25.08.2025. The copy of the communication by the Joint Director dated 22.08.2025 and communication with regard to making of payment by the college authorities dated 25.08.2025 are herewith produced for kind perusal of this Hon'ble Court.
It is respectfully submitted that, since there is some delay in considering the direction of this Hon'ble Court within a stipulated time. The accused prays your lordship to pardon the said delay as there was no intention to disobey the order of this Hon'ble Court and the delay caused is not intentional or wilful. The delay caused

is for bonafide administrative reasons. The Respondent / Accused sincerely pray tender their unconditional apology for the delay and the unconditional apology may kindly be accepted.
I respectfully submit that, the accused has got highest regard and respect for the order of this Hon'ble Court or orders passed by any Court of law. At no point of time, The Respondent / Accused disobeyed the directions/orders of this Hon'ble Court wilfully and intentionally.
The same may kindly be taken on record and pleased to drop the above said contempt Petition in the interest of justice and equity. Hence, this memo. Place: Dharwad Date: 26.08.2025 (PRAVEEN K UPPAR) ADDL GOVT. ADVOCATE AND ADV. FOR RESPONDENTS/ACCUSED
4. In view of the aforesaid facts and circumstances and the compliance memo filed by the respondents contending that they have complied with the directions issued by this Court, including the final order dated

09.12.2023 passed in WP No.112629/2014 (Lok-adalath No.1670/2023), the present contempt proceedings are closed reserving liberty in favour of the petitioner to initiate fresh contempt proceedings and also taking recourse such other remedies as available in law.
5. Subject to the aforesaid directions and liberty is reserved in favour of the complainant, the proceedings are hereby disposed off.
6. All pending IAs do not survive and the same are accordingly disposed off.
