Neutral Citation No. - 2025:AHC:84450 Court No. - 9 Case :- MATTERS UNDER ARTICLE 227 No. - 5211 of 2025 Petitioner :- Meera Devi And 2 Others Respondent :- Anand Prakash And 4 Others Counsel for Petitioner :- Ram Krishna Dubey Counsel for Respondent :- C.S.C. Hon'ble Rohit Ranjan Agarwal,J. This writ petition has been filed with the following prayer:
"issue a direction to the the Civil Judge (S.D.) Varanasi to decide application no. 15ga dated 29.04.2025 filed by the petitioners within time framed." It is contended that in the suit instituted by the plaintiff, an application 15C has been moved on 29.04.2025 for grant of interim injunction, which is pending consideration. The sole prayer made in the writ petition is for expeditious disposal of the same. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents and looking to the urgency of the matter, with a direction upon Civil Judge (Senior Division), Varanasi to expedite the said application (Paper No.15C) dated 29.04.2025 filed in Original Suit No. 2158 of 2024 (Smt. Meera Devi & Ors. vs. Anand Prakash & Ors.), in accordance with law, after hearing all affected parties, preferably within a period of two weeks from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
