Neutral Citation No. - 2025:AHC:93572-DB Court No. - 44 Case :- CRIMINAL MISC. WRIT PETITION No. - 17836 of 2023 Petitioner :- Viplove Yadav And 2 Others Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Anju Yadav,Jaysingh Yadav Counsel for Respondent :- G.A.,Mahendra Shukla Hon'ble Siddhartha Varma,J. Hon'ble Madan Pal Singh,J.
1. Heard learned counsel for the petitioners, learned A.G.A. for the State and learned counsel appearing for the informant. 2. This writ petition has been filed for quashing of the First Information Report dated 23.10.2023 giving rise to Case Crime No. 49 of 2023, under Sections 498-A, 323, 504, 506 of I.P.C. and Section 3/4 of Dowry Prohibition Act, Police Station - Mahila Thana, District - Jhansi. 3. When there was a certain misunderstanding between the petitioner no. 1 and the respondent no. 3 in their matrimonial lives, the respondent no. 3 had lodged a first information report on 23.10.2023 which had given rise to Case Crime No. 49 of 2023, under Sections 498-A, 323, 504, 506 of I.P.C. and Section 3/4 of Dowry Prohibition Act at Police Station - Mahila Thana, Jhansi. Further, it was informed by the learned counsel for the parties that the parties were sent to the Mediation Centre of the Allahabad High Court for a compromise. However, the compromise though in the Mediation Centre could not be arrived at, it was arrived at on a personal basis between the parties and a Divorce Petition was filed by the petitioner no. 1 in the Family Court at Pune. Today, a
supplementary affidavit has been filed indicating that the divorce had been decreed. The parties also submit that as per the compromise when the divorce had been granted there was no further quarrel between the parties. Learned counsel for the parties have also agreed that the terms of the compromise have been adhered to by the parties and all the payments which had to be made by the petitioner no. 1 to the respondent no. 3 have been made as per the compromise dated 17.05.2024. 4. Under such circumstances, we are of the view that the further investigation in the matter would be a futile exercise. The first information report dated 23.10.2023 which had given rise to Case Crime No. 49 of 2023 is quashed. 5. The writ petition stands allowed.
