This appeal under Section 14-A(2) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989, (for short, 'Act of 1989') is filed against impugned rejection order dated 06.11.2025 passed by learned Special Judge, under Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989, Balodabazar (CG) in Special Case SC/ST No.16/2025, whereby appellant's application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for grant of bail is rejected. Appellant is in jail since 15.07.2025 in connection with Crime No.679/2025 registered at Police Station – City Kotwali, Balodabazar, for the offence punishable under Sections 296, 351(2), 109 of BNS and Section 25 & 27 of the Arms Act and Sections 3(1)(r), 3(2)(v-a) of the SC/ST (Prevention of Atrocities) Act. 3. Case of prosecution, in brief, is that the victim is an elected Sarpanch of Gram Panchayat, Gaitra and on 14.07.2025 the victim received information that the appellant is in possession of liquor, therefore the victim went in the house of appellant and given warning, upon which, the appellant abused and threatened the victim. Thereafter the victim was going to Balodabazar and when he was filling air in his motorcycle, at that time, the appellant came there and assaulted with him thrice with the help of knife, due to which, the injured received stab injury in his abdomen. The incident was reported by Sukhram Yadav before the Police Station, Balodabazar, where the alleged offences have been registered against the appellant. 4. Learned counsel for appellant submits that appellant has been falsely implicated in this case, he has not committed any offence as alleged against him. She further submits that the appellant has neither abused the victim in the name of his caste not inflicted any grievous injury on him.
Due to previous enmity and grudge, victim has falsely implicated the appellant on the basis of his political approach. Appellant is in jail since 15.07.2025, conclusion of trial may take time, hence, appellant may be released on bail. 5. Learned State Counsel opposes the submission made by learned

counsel for the appellant. 6. Heard counsel for respective parties. 7. Considering entire facts and circumstances of case, nature of allegations and submission of counsel for the parties, further considering the allegation made against the appellant that on the date of incident, the victim received information that the appellant has kept illegal possession of liquor in his house in huge quantity, therefore the victim went in the house of appellant and given warning, upon which, the appellant abused and threatened the victim. Thereafter, the victim was going to Balodabazar and when he was filling air in his motorcycle, at that time, the appellant came there and assaulted with him thrice with the help of knife, due to which, the injured received stab injury in his abdomen. On the basis of which matter was reported. 8. Accordingly, the bail application of the applicant filed under Section 14-A(2) of the Scheduled Caste & Scheduled Tribes (Prevention of Atrocities) Act, 1989, in connection with Crime No.679/2029 registered at Police Station – City Kotwali, Balodabazar, for the offence punishable under Sections 296, 351(2), 109 of BNS and Sections 25 & 27 of the Arms Act and Sections 3(1)(r), 3(2)(v-a) of the SC/ST (Prevention of Atrocities) Act, is rejected. 9.
