Heard the parties.
The petitioner has been made accused in connection with Korrah P.S. Case No. 109 of 2024, for the offence registered under Sections 120B/34 of the Indian Penal Code and Sections 21(b), 21(c), 22(b), 22(c) and 29 of N.D.P.S. Act, 1985, pending in the court of Sri Satya Prakash Sinha, learned Session Judge-cum-Special Judge, N.D.P.S. Act, Hazaribagh.
On 26.06.2024 at about 08:45 pm, Korrah Police intercepted a motorcycle bearing registration No. JH02BP-3207 near Housing Colony Road, Nirmal Mahto Park, Hazaribagh. Petitioner and co-accused Vikash Kumar were apprehended and on search, 02 kgs of opium were recovered from their possession.
It was submitted that the quantum of seized opium comes within the purview of intermediary quantity. It was further submitted that petitioner has got no criminal antecedent and this fact has been mentioned at paragraph-14 of the bail application.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Sri Satya Prakash Sinha, learned Session Judge-cum-Special Judge, N.D.P.S. Act, Hazaribagh, in connection with Korrah P.S. Case No. 109 of
2024.
