ORDER ON BOARD 04.12.2025
1. This writ petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:-
“10.1 That, this Hon’ble Court may kindly be pleased to issue suitable writ (s), order (s), direction(s) by commanding/directing the Collector Jangjir-Champa to decide the representation (Annexure P/3) preferred by the petitioner for payment of suitable compensation to the petitioner, strictly in accordance with law, within a time frame, in the interest of justice. 10.2 That, this Hon’ble Court may kindly be pleased to call the entire records from the respondents authorities for its kind perusal. 10.3 Any other relief, which may be suitable in the
facts and circumstances of the case, may also be granted.”

Learned counsel for petitioners submits that petitioner’s land has come within the premises of respondent no. 6 company, however, no compensation has been paid to petitioner. Thereafter petitioner has submitted a representation before the Collector/respondent no. 3 upon which Collector has forwarded the claim of petitioner to Sub Divisional Officer (Revenue) i.e. respondent no. 4 for further action, however till date no action has been taken by the concerned authority, therefore, direction be issued to respondent no. 4 to proceed with the memo issued by Collector at the earliest within specified time frame.

Learned counsel for State submits that in view of the limited prayer made by counsel for the petitioner pursuant to memo dated 11.09.2025 Annexure P-4, he is having no objection.

On due consideration of submission made by learned counsel for respective parties as also the report Annexure P-3 submitted before the Collector/respondent no. 3 and the memo Annexure P-4 dated 11.09.2025 forwarded by Collector/respondent no. 3 to respondent no. 4, respondent no. 4 is directed to proceed in accordance with the direction issued by Collector, Janjgir-Champa on the memo dated 11.09.2025 and to submit its report to Collector/respondent no. 3 informing petitioner preferably within in a further period of six months from the date of receipt of copy of this Order.
