This Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the respondents authorities for payment of CPF / or Family Pension under the Pension scheme, 1995 and further the petitioners are entitled to get the penal interest @ 18% p.a. with the respondent No.3 & 4. b. This Hon’ble Court may kindly be pleased to direct the respondents – authorities for allowing the service terminal benefits in accordance with law as the similar situated employees are getting in pursuance to the order of this Hon’ble Court. c. Any other relief as the Hon’ble Court may be deemed fit and 3 proper. d. Cost of petition may kindly be allowed. 2. Learned counsel for the petitioner submits that the petitioner has not been paid family pension, therefore, this writ petition has been filed. 3. Learned counsel for respondents 1 and 2 inviting attention of this Court submits that all the petitioners either enjoyed withdrawal benefit under ceased Family Pension Scheme, 1971 or pension had already been settled under Employees’ Pension Scheme, 1995 according to the provisions of the scheme and merit of the case. For ready reference, paragraph 17 of the return filed by respondent no.1 is quoted herein below - 17. That, the answering respondents denies and dispute the averment of petitioners regarding payment of pension either under ceased Family Pension Scheme 1971 or continuing Employee’s Pension Scheme, 1995. It is crystal clear that all the petitioners either enjoyed withdrawal benefit under ceased Family Pension Scheme, 1971 or pension had already been settled under Employee’s Pension Scheme, 1995 according to the provisions of the scheme and merit of the case. In the matter respondent no.2 humbly produce a position w.r.t. to petitioners in brief before the Hon’ble Court which is marked as Annexure R1/1. 4. In view of above, this writ petition is disposed off, however, liberty is reserved in favour of the petitioner to revive this petition in case any further cause of action survives.
