1. Heard learned Counsel for the parties.
2. The Appellant/complainant has filed this acquittal appeal against the
judgment dated 23.01.2018 passed by learned Judicial Magistrate First Class, Dondilohara, District – Balod (C.G.) in Criminal Case No. 75/2017 whereby the accused/respondent has been acquitted of the offence under Sections 279, 337, 338 of the Indian Penal Code, 1860.
3. After arguing for sometime, learned Counsel for the Appellant/State seeks permission to withdraw this acquittal appeal with liberty to approach the appropriate Court, in view of provision of Section 372 of the Cr.P.C.

5. Accordingly, this acquittal appeal is dismissed as withdrawn with the liberty, as prayed for by the counsel for the Appellant/State.
