By virtue of the present bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the applicant seeks grant of regular bail in FIR No.286/2025 dated 02.06.2025 registered at PS.: Mandawli Fazalpur, Delhi under Sections 80(2)/85/3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

Succinctly put, upon receiving a PCR call on 02.06.2025, the IO reached the spot and found that the one female (deceased) was found lying on the bed in an unconscious condition and appeared to be dead. months before the incident) and thence upon the statement made by the complainant, i.e., father of the deceased, the present FIR was registered.
3. Subsequently, during further investigation 04.06.2025, the Police after recording the statement of the applicant, arrested him. Thereafter since the statements of relevant public witnesses and Police witnesses were recorded and sufficient material was gathered, charge-sheet was filed before the learned Trial Court.
4. In these facts, this Court has heard learned counsels for the applicant and the deceased, and the learned APP, as also gone through the materials on record.
5. As borne out from the record and also the submissions made by the
learned counsel for the parties, there is no disagreement qua the fact that the charges have recently been framed on 27.07.2026 before the learned Trial Court, and the applicant has been discharged of offences under Sections 80(2) and 3(5) BNS, consequently the charges against him have only been framed under Section 85 BNS, whereby the maximum sentence that can be imposed is up to three years. It is also incontrovertible that the applicant is facing incarceration since 04.06.2025 and has been inside judicial custody for almost a period of fourteen months (approximately) and his conduct has been ‘Satisfactory’ while inside jail as per the Nominal Roll received. Moreover, the applicant is a first-time offender. 6. Even though the present is a case wherein the deceased expired within three months of her marriage with the applicant, and though after being discharged of offences under Sections 80(2) and 3(5) BNS on 27.07.2026, the applicant has not approached the learned Trial Court, however, considering the said order of discharge, which, has only been This is a digitally signed order. passed during the pendency of the present application made by the applicant before this Court in December, 2025, the present application is being dealt with. 7. Taking the aforesaid cumulatively, as also since the proceedings before the learned Trial Court is unlikely to conclude in the near future and under the existing facts and circumstances involved, the applicant is able to make out a case for grant of regular bail. 8.
Accordingly, the applicant be released on regular bail in FIR No.286/2025 dated 02.06.2025 registered at PS.: Mandawli Fazalpur, Delhi under Sections 80(2)/85/3(5) of BNS, subject to him furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) along with one surety of the like amount by a family member/ friend having no criminal case pending against him/ her and subject to the satisfaction of the learned Trial Court, and further subject to the following conditions:- i. Since the applicant is a resident beyond the jurisdiction of this Court, he shall reside within the precincts of the local Police Station as mentioned in the TCR and in any case shall not leave the country without following the due process of law. ii. Applicant shall surrender his Passport, if any, to the IO within three days of his release. iii. Applicant shall provide his mobile number to the IO concerned which shall be kept in working condition at all times. iv. Applicant shall not indulge in any criminal activity and shall not communicate with or come in contact with any of the prosecution witnesses, or tamper with the evidence of the case. 9. A copy of this order be sent to the learned Trial Court and concerned Jail Superintendent for necessary information and compliance forthwith. 10. The present application is allowed and disposed of in the aforesaid terms. 11. Needless to say, expression of view(s) on the merits, if any, are solely for the purposes of adjudication of the present application and shall have no bearing on the overall case/ trial involved.
