This writ petition has been filed seeking following relief :- "Issue a writ order or direction in the nature of mandamus commanding the Additional Commissioner (Judicial-I) Varanasi Division, Varanasi to stay operation and implementation of order of Upziladhikari dated 13.12.2023 and further restrained the respondents from interfering in possession of the petitioners whatsoever, ignoring his order rejecting the stay application." 3. Learned counsel for the petitioner submitted that against the order dated 13.11.2023, an appeal has been filed by the petitioner bearing Case No.79/2024, Computerized Case No. C202414000000079 (Kripa Shankar Singh and others Vs. Rajendra Prasad and others). The said appeal has been admitted by the Appellate Court by order dated 22.11.2024 but rejected the stay application filed by the petitioner. 4. Since the order rejecting the application for interim relief has been passed more than five months back and above-mentioned appeal is pending for more than six months, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to respondent No.1 to decide the above-mentioned appeal, in accordance with law, expeditiously, preferably within three months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
