1. Pursuant to the order dated 10.11.2025, the victim along with her father appeared through virtual mode from DLSA, Mungeli, and submitted objection in granting bail to the applicants, their submission is taken on record.
2. This is first bail application before this Court filed by applicants for grant of regular bail, who have been arrested on 04.07.2025 in
2 connection with Crime No.82/2025 registered at Police Station - Jarhagaon, District- Mungeli (C.G.), for the offence under Sections 137(2), 87, 64(1), 3(5) of BNS and Sections 4 & 6 of the POCSO Act.

Case of the prosecution is that on 25.06.2025, father of victim lodged missing report that his minor daughter (aged about 17 years, 11 months & 21 days) is missing since 24.06.2025 and her whereabout could not be traced out. The Police has registered the offence under Section 137(2) of BNS, 2023 and started investigation. During investigation, the victim herself had gone to the Police Station on 01.07.2025 and after recording her statement, the other offences of Sections 87, 64(1), 3(5) of BNS, 2023 and Sections 4 & 6 of the POCSO Act has been added. The applicants have been arrested on 04.07.20205 and charge- sheet has been filed.

Learned counsel for the applicants would submit that the victim is a major girl having love affair with applicant No.1, they were having love affair since 3-4 years, victim has eloped with him on her own will, she has not raised any alarm/objection when she was being taken by the applicant. She engaged in making consensual physical relation, however, under the pressure of her parents, she made statement against the applicants. Charge- sheet has been filed, applicants are in jail since 04.07.2025, and final adjudication of the case will take its own time, therefore, they may be enlarged on bail.

5. On the other hand, learned counsel for the State opposes the bail application of the applicants.
6. I have heard learned counsel for the parties and perused the case diary.

Considering facts of the case, submissions made by learned counsel for the parties, nature of allegation, material collected during the investigation, particularly age and statement of victim recorded under Section 183 of BNSS, 2023, further considering that applicants are in jail since 04.07.2025 and final adjudication of the case will take its own time, without commenting on merits of the case, I am inclined to release the applicant on bail.
8. Consequently, bail application filed by the applicants for grant of regular bail is hereby allowed. It is directed that the applicants shall be released on bail on their furnishing a personal bond in the sum of Rs. 25,000/- each with one surety in the like sum to the satisfaction of concerned trial Court, on following conditions:- (i) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court. (ii) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial, and (iii) The applicants shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial unless their personal presence are exempted by the trial Court.
