ORDER ON BOARD 01 /12/2025
1. The petitioner has filed this writ petition seeking following reliefs:-

“10.1 That, the Hon’ble Court may kindly be pleased to direct the Respondent No. 2 to hear and decide the Case No. 04/A-89/2024-25. 10.2 That the Hon'ble Court may kindly be pleased to direct the respondent authorities to conduct inquiry upon the manipulation of proceedings of Gram Sabha dated 24.04.2022. 10.3 That, any other relief, this Hon’ble Court deem fit and proper may also be granted to the petitioner, in the interest of justice.”

Learned counsel for the petitioner submits that the petitioner submitted an application against the Respondent No. 5 under the provisions of Section 36 (3) of the Chhattisgarh Panchayati Raj Adhiniyam, 1993 (hereinafter for brevity referred to as the Adhiniyam, 1993). On the application of the petitioner, the Respondent No. 2/Collector has registered the case and have directed the Respondent No. 4/Teshsildar to submit report. However, till date, the report has not been submitted and therefore, the proceedings is pending consideration before the Respondent No. 2/Collector since 09.05.2025 and therefore, direction be issued to the Respondent No. 2/Collector to conclude the proceedings initiated at the earliest.
3. On the other hand, learned counsel for the Respondents/State submits that in view of the limited prayer made by the counsel for the petitioner, he is having no objection. He however, submits that according to documents annexed along with the writ petition at page no. 40, the order-sheet of the Tehsildar dated 03.10.2025 would show that the Tehsildar has already prepared a report and forwarded it to the Respondent No. 2/Collector through proper channel i.e. the Sub-Divisional Officer (Revenue). He contended that the proceedings will be concluded in accordance with law.
4. I have heard learned counsel for the parties and also perused the documents placed on record.
5. In view of the aforementioned facts of the case, submission of counsel for the parties, nature of proceedings which is registered by the Respondent
3 No. 2/Collector under the provisions of Section 36 (3) of the Adhiniyam, 1993, this writ petition is disposed of directing the Respondent No. 2/Collector to conclude the proceedings in accordance with law, expeditiously, preferably within an outer limit of 06 months from the date of receipt of the order.
6. With the aforesaid observation and directions, this writ petition stands
