THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1162 OF 2025 ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking bail, in Crime No.539/2024 of Sarpavaram Police Station, Kakinada District. 2. A case has been registered against the petitioner and others for the offence under Section 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act. 3. Case of the prosecution, in brief, is that, on 07.11.2024 at about 6.00 am, on receipt of credible information regarding illegal possession and transportation of ganja, the S.I of Police, Sarpavaram Police Station, along with staff and mediators, started conducting vehicle checking at drainage canal bund, near dumping yard, Ramanayyapeta, Kakinada Rural Mandal and observed A1 and A2 in suspicious circumstances. On interrogation, A1 and A2 disclosed their identity particulars and police found 21 kgs of ganja in their possession. On enquiry, A1 and A2 confessed that they fetched the same from A3 and A4. Police seized the contraband and the vehicle and arrested the accused and got them remanded to judicial custody on 07.11.2024. 4. Heard. Perused the record. 2 5. Learned Assistant Public Prosecutor submits that investigation is not yet completed and some more witnesses are to be examined and further submitted that there are two other cases registered against the petitioner for the similar offence. He further submitted that the petitioner stopped his studies and was doing illegal activities like this nature and prays to dismiss the Criminal Petition. 6. A perusal of the material available on record goes to show that the petitioner/A1 was arrested and remanded to judicial custody on 07.11.2024, and police on credible information seized 21 kgs of ganja, which is a commercial quantity, from the possession of the petitioner and another accused. As stated by the learned Assistant Public Prosecutor that there are two other cases registered against the petitioner for the similar offences and the investigation is at nascent stage. In the circumstances, this Court is not inclined to grant bail to the petitioner at this stage. 8. Accordingly, the Criminal Petition is dismissed. _______________________ K.
