This first bail application has been filed on behalf of the applicant under Sections 483 of the Bharatiya Nagarik Surksha Sanhita, 2023 (for short the “BNSS”) for grant of bail in connection with Crime No. 140 of 2015, registered at Police Station Balod, District Balod (CG) for the offences punishable under Section 420/34 of IPC and also under Section 3,4 & 5 of Inami Chit-Fund & Prize Money Circulation (Prohibition) Act and Section 10 of the Protection SAIFAN KHAN Digitally signed by SAIFAN KHAN Page No.2 of 3 IN MCRC-9623-2025 of Depositors Interest Act (though same has not been charged by the trial Court). 3. As per prosecution’s case, other co-accused persons in the crime opened a Branch of Divyani Properties in Balod and through the medium of local agents, lured the general public and got the money deposited from them on the pretext of buying land and on the ground that their money will get doubled in 5 years, however, after completion of 5 years, the money deposited by the people was not returned to them. So far as the present applicant is concerned, he was one of the agent in the said firm. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated. Similarly situated co- accused persons, namely, Shivlal Raj & Smt. Seema Chaudhari have been enlarged on bail by this Court vide order passed in MCRC No.5076 of 2015 & MCRC No.962 of 2025, dated 06.10.2015 & 01.08.2025 (Annexure-A/3) respectively. Charge-sheet has been filed and the applicant is in jail since 29.09.2025 and, therefore, the applicant be enlarged on bail. 5. On the other hand, learned Panel Lawyer appearing for the respondent-State opposed the bail application and submits that the present application deserves to be rejected. After hearing learned counsels for the parties, considering the facts and circumstances of the case as well as the nature and gravity of offence and going through the material available on record including the case diary and specially taking into consideration the fact that similarly situated co-accused, namely, Shivlal Raj & Smt. Seema Chaudhari have been granted bail by this Court and the period of pre-trial detention and charge-sheet has been filed in this case and trial would take prolonged period of time to be concluded, I am inclined to allow this application and enlarge the applicants on bail. 7. Accordingly, applicant namely, Rajesh Kumar Yadav is directed to be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) with one solvent surety each in the like amount to the satisfaction of the concerned trial Court for his appearance before the concerned trial Court as and when directed. 8.
