THOTA S V L NARASIMHASWAMY 2 The Court made the following: ORDER: This instant Criminal Petition is filed by the Petitioners seeking the following relief: “ ... to Quash the C.C.4147/ 2019 on the file of 1St Additional Chief Metropolitan Magistrate, Visakhapatnam, Visakhapatnam District and pass .... ” 2. Heard Sri Rambabu Koppineedi, learned counsel for the Petitioners, Ms.Priyanka Lakshmi, learned Assistant Public Prosecutor appearing for respondent No.1 -State and learned counsel for respondent No.2. Perused the material on record. 3. Learned counsel for the Petitioners would submit that Petitioners 1 and 2 are father and mother of A.1. Learned counsel would submit that the marriage of A.1 with respondent No.2 was performed on 17.05.2017 and they lived at Attapur, Hyderabad for two months and thereafter some disputes arose between the couple. Learned counsel would submit that respondent No.2 gave a complaint to the Police, which was registered as a case in Crime No.60 of 2019 of Women Police Station, Visakhapatnam and after completion of investigation, Police filed charge sheet, which is numbered as CC No.4147 of 2019 on the file of the Court of I Additional Chief Metropolitan Magistrate, Visakhapatnam, and taken cognizance of the offence punishable under Sections 498-A, 323 IPC and Sections 3 and 4 of the Dowry Prohibition Act, against A.1 to A.5, who are husband, father-in-law, mother-in-law sister-in-law and sister-in-law’s husband of respondent No.2. Learned counsel would submit that except omnibus 3 allegations, have nothing to do with the present case and a false case has been lodged against the Petitioners. Except bald and omnibus allegations, no specific overt acts are attributed against the Petitioners and prays for quashment of the case against the Petitioners. Learned counsel further would submit that the petition may be disposed of dispensing with the presence of the Petitioners before the trial Court and by giving liberty to the Petitioners to raise such contentions before the trial Court in defence. 4. Considering the submissions made, this Criminal Petition is disposed of and the Petitioners are at liberty to raise the present contentions before the trial Court in their defence. However, the presence of the Petitioners/A.1 and A.2 before the trial Court is dispensed with, except on the specific dates as directed by the trial Court.
