JUSTICE S G PANDIT) This contempt petition is filed under Sections 10 and 12 of the Contempt of Courts Act, 1971 read with Article 215 of the Constitution of India alleging violation of order dated 22.06.2023 passed in FDP No.31/2021 on the file of learned I Addl. Senior Civil Judge, Hubballi. 2. Heard the learned counsel for the complainant and perused the entire contempt petition papers. 3. Learned counsel for the complainant would submit that under order dated 22.06.2023 passed in FDP No.31/2021 on the file of learned I Addl. Senior Civil Judge, Hubballi, in respect of Schedule A & B properties, the petitioner and respondents No.3 to 6 each are entitled to 1/6th share out of compensation awarded by KIADB. He submits that the order would declare that the legal representatives of the respondent No.1 Shivappa shall be equally entitled to 1/6th share of respondent No.1 in the said compensation amount. Learned counsel would submit that the complainant/respondent No.9 would be entitled for equal share among legal representatives of respondent No.1 Shivappa. - 3 - HC-KAR NC: 2025:KHC-D:14537-DB CCC No. 100332 of 2025 4. There is no specific direction to pay any compensation to respondent No.9/complainant herein. The complainant/respondent No.9 has to claim his share by establishing that respondent No.9 is also legal representative of respondent No.1 Shivappa in the said FDP proceedings. Moreover, KIADB is not a party to the proceedings in FDP No.31/2021. The settlement, if any, in FDP No.31/2021 is between the parties to the said FDP proceedings. 5. Therefore, in the above circumstances, it cannot be said that the respondents/accused have violated the order dated 22.06.2023 passed in FDP No.31/2021.
