This application has been filed by the petitioner seeking condonation of delay of 44 days in filing the rejoinder. 2. For the reasons stated in the application, the delay is condoned. 3. It is the case of the petitioner that the petitioner’s father had donated land in pursuance of the policy introduced by the respondent no.1/ DJB in the year 1991-92. In terms of the said policy, a person who donated their land for the purposes of installation of a tubewell was entitled to employment with the respondent no.1/ DJB. 6. Pursuant to the said policy, the respondent no. 1 had installed four (4) tubewells at Khasra Nos. 166, 167, 168 and 169 located at Village Jhangola, Delhi. 7. On 4th July, 2002, the aforesaid policy was discontinued with retrospective effect and hence, the claim of the petitioner for employment with the respondent no.1/DJB was rejected. 8. In the counter-affidavit filed on behalf of the respondent no.1/ DJB, it is stated that the present writ petition is barred by delay and laches as the petitioner claims that the land was donated by the father of the petitioner in the year 1990-92. However, the demand for muster roll engagement was only made in the year 2015, long after the policy was discontinued on 4th July, 2002. This is a digitally signed order. It is further stated on behalf of the respondent no.1/DJB that a joint inspection was carried out in the presence of the petitioner and the Halka Patwari for demarcation of the land. In the final report of the Halka Patwari, it is stated that the land in question was acquired vide award dated 18th August, 1980. Paragraph nos.10, 11 and 12 of the counter-affidavit are set out below: 10. From a reading of the aforesaid averments in the counter-affidavit, it is a disputed question whether the land in question belongs to the petitioner or his father. 11. It is also clear from the record that the present writ petition has been filed in a highly belated manner. This is a digitally signed order.
