Hon’ble Smt. Justice Rajani Dubey Hon’ble Shri Justice Amitendra Kishore Prasad
Order on Board Per Rajani Dubey, J. 05.12.2025
1. The present review petition has been filed seeking modification of the judgment dated 08.08.2024 passed by this Court in FA(MAT) No. 156/2022.
2. Learned counsel for the petitioner submits that while dismissing the appeal i.e. FA(MAT) No. 156/2022, this Court in para 17 of the
judgment dated 08.08.2024 directed payment of alimony of Rs. 15,000/- per month to the respondent wife noting that she was already receiving Rs. 6,000/- per month as maintenance vide
order dated 05.03.2024 passed by the Family Court, Khairagarh. It is contended that since the income of the appellant husband has been recorded as Rs. 58,980/- per month, the intention of this Court was to grant a total amount of Rs. 15,000/- per month as alimony/maintenance and not Rs. 15,000/- in addition to the existing Rs. 6,000/-. Therefore, the petitioner seeks clarification/modification to the extent that the respondent wife be entitled to only Rs. 15,000/- per month in total.
3. On the contrary, learned counsel for the respondent opposes the petition and submits that pursuant to the judgment dated
3 08.08.2024, the respondent wife is receiving only Rs. 15,000/- per month and therefore no modification is warranted.
4. Heard learned counsel for the parties and perused the record.
5. Upon due consideration of the submissions advanced and the material available on record, the review petition is allowed to the limited extent that para 17 of the judgment dated 08.08.2024 shall stand modified. It is clarified that since the respondent wife is already receiving Rs. 6,000/- per month as maintenance, it would be appropriate to grant an additional sum of Rs. 9,000/- per month towards alimony. Consequently, the respondent wife shall be entitled to a total amount of Rs. 15,000/- per month as alimony, payable by the appellant husband from the date of the original
judgment. The said amount shall continue to be deducted from the salary of the appellant and remitted to the respondent wife through the Court below.
6. The copy of this order shall form part of the records of FA(MAT) No. 156/2022. Sd/- Sd/- (Rajani Dubey) (Amitendra Kishore Prasad) Judge Judge Ruchi RUCHI YADAV Digitally signed by RUCHI YADAV
