01. The petitioner is aggrieved of the communication bearing No. DCG/Estt./F-121-Lum/2023 dated 16th May, 2024, issued by the Assistant Commissioner Revenue, Ganderbal, to the Tehsildar Kangan, whereunder, the appointment of the petitioner as Lumberdar of village Plung of the District Ganderbal, confirmed earlier vide Order dated 30th March, 2024, has been cancelled for want of CID clearance.
02. It is submitted by the learned counsel for the petitioner that petitioner is a law abiding and responsible citizen of the Country and a domicile of
the Union Territory of Jammu and Kashmir hailing from village Plung of the District Ganderbal, who has not been involved in any sort of antinational or antisocial activity. He further submitted that the brother of the petitioner was earlier involved in criminal case, in which, he has already been acquitted.
03. In the light of the averments of the petition, this Court is of the opinion that the instant petition can be disposed of at its threshold stage by passing appropriate orders.
04. Accordingly, the instant petition is disposed of with the direction to the respondents to reconsider the cancellation of the appointment of the petitioner after providing an opportunity of being heard to him.
05. Disposed of in the aforesaid terms.
