The petitioner has filed the instant petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of FIR No.177 dated 20.07.2020 registered under Sections 307, 498-A and 506 of Indian Penal Code, 1860 at Police Station Model Town, District Hoshiarpur. 2. On receipt of advance copy of the petition, Mr. Adhiraj Singh, A.A.G., Punjab has put in appearance on behalf of the respondent-State and on instructions, submits that although, the FIR in question was registered against 05 accused, however, the challan was presented only against Kuldeep Kumar and the remaining accused were kept in column No.2. He has also produced copy of order dated 06.11.2024 passed by learned Judicial Magistrate First Class, Hoshiarpur, wherein it has been stated that the only accused namely Kuldeep Kumar has unfortunately died and proceedings against him Vinod Kothiyal 2025.05.23 13:43 I attest to the accuracy and authenticity of this document CRM-M-28178-2025 -2- stands abated. He further submits that the complainant is not made a party in the present petition. 3. Faced with this situation, learned counsel for the petitioner wishes to withdraw the present petition with liberty to file fresh one on the same cause of action with better particulars by impleading the complainant as a party respondent. 4.
