2 registered at Police Station – Kasdol, District – Balodabazar- Bhatapara (C.G.) for the offence punishable under Sections 420, 409, 418 & 34 of IPC.

The prosecution story in brief is that it is alleged that on 28.07.2023 complainant Chhedilal Sahu went to the house of the applicants to meet Ramnarayan Sahu and his son Gulshan Sahu and during that he was offered to invest in share trading to double the amount invested, On such assurance the complainant invested Rs. 20,00,000/-through RTGS and rest amount in cash, total sum of Rs. 39,10,000/- was invested to be doubled in period of two years, but applicants did not returned the amount thereby committed cheating with the complainant. Hence the offence has been registered.

Learned counsel appearing for the applicant submits that the applicants are innocent and have been falsely implicated in the present case. The present applicants have been made accused solely on the basis of their familial relationship with the accused Ramnarayan Sahu, being his real brother and cousin brother, respectively, and there is no direct allegation implicating them in the offence. The applicants are family members of the co-accused, and it appears they have been unnecessarily made accused to harass their family, whereas no involvement in cheating or any other offence has been attributed to them. It is further submitted that Applicant No. 1 is physically disabled in his left leg and cannot perform any work without assistance. The applicants have been in judicial custody since 25.06.2025, the chargesheet has already been filed, and the offence is triable by the Sessions Court, with the
3 trial likely to take a reasonable time. It is also submitted that other co-accused persons have already been granted bail by this Hon’ble High Court. In view of these facts and circumstances, it is respectfully prayed that the applicants may be released on bail. 4. Learned State Counsel opposes the bail application and submits that on 28.07.2023, the complainant, Chhedilal Sahu, invested a total sum of Rs. 39,10,000/- with the applicants in a share trading scheme on the assurance that the amount would be doubled. The applicants allegedly failed to return the invested amount, thereby committing an offence of cheating. In view of the seriousness of the allegations, the substantial amount involved, and the prima facie evidence on record, it is submitted that the applicants are not entitled to the benefit of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence alleged against the applicants, and the material available on record, it appears that the complainant, Chhedilal Sahu, visited the house of the applicants to meet Ramnarayan Sahu and his son, Gulshan Sahu. During the meeting, the complainant was allegedly offered an opportunity to invest in share trading with the assurance that the invested amount would be doubled. Relying on this assurance, the complainant invested Rs. 20,00,000/- through RTGS and the remaining amount in cash, making a total investment of Rs.39,10,000/-, which was to be
4 doubled within a period of two years.
The applicants, however, allegedly failed to return the invested amount, thereby committing an offence of cheating against the complainant. In view of the seriousness of the allegations, the substantial amount involved, and the prima facie evidence on record, this Court finds no ground to extend the benefit of bail to the applicants. Accordingly, the bail application is rejected. 7. Accordingly, this bail application of applicants – Dev Narayan Sahu, Ram Narayan Sahu & Anil Shankar Sahu involved in Crime No. 433/2025 registered at Police Station – Kasdol, District – Balodabazar-Bhatapara (C.G.) for the offence punishable under Sections 420, 409, 418 & 34 of IPC, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
