The petitioner has filed this petition praying for following relief:- “It is therefore most humbly and respectfully prayed that the First Information Report dated 21-01- 19 bearing F.I.R no. 35/19, registered at Police Station- Kotwali, Jagdalpur, District-Bastar (C.G) under section 294, 323, 506, 354 of the Indian Penal Code and also the chargesheet dated 11-02-19 filed by the police of police station Kotwali, jagdalpur, District- Bastar (C.G), be quashed and the impugned order dated 01-10-2025 (Annexure P/1) passed by the learned Judicial Magistrate 1st Class, Bastar, Place- Jagdalpur (C.G) in Criminal Case no. 231/19 between State of C.G and Bhuwanlal Deangan" be set aside and the pending criminal proceeding pending before the learned Judicial Magistrate 1st Class, Bastar, Place-Jagdalpur (C.G) in Criminal Case no. 231/19 between " State of C.G and Bhuwanlal Deangan” may kindly be compounded and quashed, in the interest of justice.” 3. Learned counsel for the petitioner prays to withdraw the present petition with liberty to file afresh stating that an application under Section 320 of Cr.P.C. has been moved by the petitioner as well as respondent No.2 before the learned trial Court in terms of agreement arrived between the parties and further, in another case wherein respondent No.2 is a party, another application under Section 320 the Cr.P.C. has been moved before the trial Court in terms of the same contract, which is still subjudice. 4. In view of the same, as prayed by learned counsel for the petitioner, this petition is dismissed as withdrawn, with liberty to 3 file afresh. 5. Learned Panel Lawyer appearing for respondent No.1 / State as well as respondent No.2 is present. 6. Certified copy of the documents annexed in the petition, if any, may be returned back to the counsel for the petitioner after obtaining the photocopy of the same.
