ORDER WAS MADE THEREIN AS UNDER:
ORAL ORDER (PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ)
1. Learned AGA accepts notice for respondents No.1 to 3.
2. Ms.Sonu Suhel.N., learned counsel who has filed Caveat for respondent No.5 accept notice for respondent No.5.
3. The Petitioner is before this Court seeking for the following reliefs:

a. Issue a writ in the nature of Certiorari or any other writ or order or direction quashing the order dated 18.7.2025 bearing Pra. Bhu Jam Ni: Pa.A/36/2025- 26 passed by the R1 produced as Annexure-L and the order dated 25.7.2024 bearing No. Bu U Ni/Tam/ Appealu/151/2023-24 passed by the R2, produced as Annexure-H.
b. Such other writ or order or direction as deemed fit under the facts and circumstances of the case including an order for cost may kindly be passed, in the interest of justice and equity.
4. Though the 2 rounds of litigation which occurred between the parties before the ADLR, Appeal before the DDLR and Revision before the JDLR and a remand had been made by JDLR to DDLR. The fact remains that the application which had been filed by respondent No.5 for condonation of delay has not been considered by any of them and delay is yet to be considered. Without said application being considered the matter could not have proceeded to be taken up by the Authorities on merits.
5. In that view of the matter, the orders which have been passed and impugned herein are not sustainable. As such, I pass the following;

ORDER
i. The writ petition is allowed. ii. A certiorari is issued, order dated 18.7.2025 bearing Pra. Bhu Jam Ni:Pa.A/36/2025-26 passed by respondent No.1 at Annexure-L and the order dated 25.7.2024 bearing No.Bu U Ni/Tam/ Appealu/151/2023-24 passed by Respondent No.2 at Annexure-H are quashed. iii. The matter is remand to respondent No.2 to consider and pass necessary orders on the application for condonation of delay within a period of 30 days from the date of receipt of copy of this order. iv. It is made clear that this Court is not express any opinion on the application of the condonation of the delay. v. All contentions are left open, including maintainability. vi.
