This petition has been filed by the petitioner seeking for the following relief(s):- “10.1. That, this Hon'ble Court may kindly be pleased to issue writ/order/suitable direction towards the Respondents No. 2 to 6 to grant written permission to the petitioner for construction of residential house in the part of Khasra No. 449/1 area 2 ½ decimal land situated at P.H. No. 04, Village – Hasda No. 1, Tehsil – Magarlod, District – Dhamtari (C.G.) as per the scheme of Prime Minister Awas Yojna. 10.2 The Hon’ble Court may kindly be pleased to issue writ/order/suitable direction towards the Respondents No. 3 to 8 to do not disturb the peaceful possession of the petitioner in the part of Khasra No. 449/1 area 2 ½ decimal land situated at P.H. No. 04, Village – Hasda No. 1, Tehsil – Magarlod, District – Dhamtari (C.G.). 10.3 that, the Hon’ble Court may kindly be pleased to grant any other relief, as if may deem fit and appropraite. 10.4 Cost of the petition may also be given.” 2. On the objection being raised by the learned counsel for the Respondents/State that the primary grievance of the petitioner appears to be against the order fo Tehsildar dated 31.01.2025 whereby, the application submitted by the petitioner for grant of patta on government land was rejected observing that he is not having the authority for allotting the land on patta. 3. He submits that the appropriate authority to consider the claim of the allotment of the land, if any in favour of the petitioner would be the Collector and petitioner has not submitted any application before the Collector, till date. 4. At this stage, learned counsel for the petitioner seeks permission of this Court to withdraw this writ petition at this stage with liberty to file an appropriate application before the appropriate authority. 5. In view of the submissions made by counsel for the petitioner, this writ 3 petition is dismissed as withdrawn with liberty as prayed for. 6. Certified copy as per rules.
