THIS PETITION COMING ON FOR PRELIMINARY HEARING THIS DAY, ORDER WAS MADE THEREIN AS UNDER: ORAL ORDER (PER: THE HON'BLE MR. JUSTICE PRADEEP SINGH YERUR) Heard the learned counsel for the petitioner and the learned HCGP for the respondent/State. 2. It is the case of petitioner that she has applied for the post of Anganawadi Assistant along with all required documents for Anganawadi Centre at Hullur-71, which was unreserved and open to candidate belongs to the General Merit as per the notification issued by the Deputy Director, Women and Child Development Department, Gadag. Upon evaluation of the applications, the 2nd respondent published a ‘Provisional Selection List’ dated 30.11.2024 and calling the objections, if any to be submitted by 16.12.2024 by 5:30 p.m. The petitioner’s name was duly included in the ‘provisional selection list’ for the Hullur-71 Anganawadi Centre as the sole candidate for the said post under the - 3 - HC-KAR NC: 2025:KHC-D:8661 WP No. 104013 of 2025 General Merit and no objections were received against the petitioner’s candidature with time stipulated. 3. It is further submitted by the petitioner that to the utter shock and dismay of the petitioner, when the ‘Final Selection List’ was published on 04.03.2025, the selection for Hullur-71 Anganawadi Centre was shown as ‘process is withheld due to the case is pending before the Court’ and no particulars of the case were provided in the list. Further, the petitioner submitted a detailed representation on 15.04.2025 to the 2nd respondent requesting clarification and inclusion of her name in the final selection list as per the merit list. Despite the said representation, no action has been taken by the authorities till date. Hence, the petitioner is before this Court. 4. Learned HCGP representing the State submits that the representation so made by the petitioner would be considered, if reasonable time is granted. Under the circumstances, I pass the following: - 4 - HC-KAR NC: 2025:KHC-D:8661 WP No. 104013 of 2025 ORDER i) The petition is allowed. ii) A writ of mandamus is issued directing respondent No.2 to consider the representation of the petitioner dated 15.04.2025 as per Annexure-E and pass suitable orders in accordance with law, within an outer limit of two months from the date of receipt of a copy of this order.
