ORDER ON BOARD 01 /12/2025
1. The petitioner has filed this writ petition seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to call for the entire records pertaining to the case of the petitioner. 10.2 That the Hon'ble Court may kindly be pleased to set-aside/quash the order dated 08.08.2025 (Annexure P/1), passed by the Respondent No. 3.
2 10.3 That, this Hon’ble Court may kindly be pleased to set-aside/quash the allotment order dated 22.08.2025 (Annexure P/2), passed by the Respondent No. 3. 10.4 That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to operate her Lakshmi Prathmik Sahkari Upbhokta Bhandar Kelabadi (Government Fair Price Shop) bearing ID No. 431001051 situated at Kelabadi, District – Durg. 10.5 Any other relief which this Hon’ble Court may deem fit and proper in favour of the petitioner may kindly be passed.”
2. Learned counsel for the petitioner submits that pursuant to the enquiry report dated 10.06.2025, the Collector (Food Branch), District – Durg vide
order dated 08.08.2025 have suspended the operation of the petitioners to run the Government Fair Price Shop allotted to it before and have temporarily handed over the possession to the Respondent No. 4 for its operation observing the show-cause notice issued to the petitioner after enquiry report. He contended that though the order is dated 08.08.2025, however, till date, the Respondent No. 2/Collector has not finalized the proceedings based on the show-cause notice issued to the petitioner. The petitioner has submitted reply to the show-cause notice vide Annexure P/6 on 17.09.2025 and therefore, direction be issued to the Respondent No. 2/Collector to conclude the proceedings initiated against the petitioner based on the show-cause notice at the earliest.
3. On the other hand, learned counsel for the Respondents/State do not dispute the submission of counsel for the petitioner. However, she submits that the petitioner was granted an opportunity of hearing to which, reply is submitted. Proceedings if any, is still pending consideration, it will be concluded in accordance with law at the earliest.
4. I have heard learned counsel for the parties and also perused the documents placed on record.

In view of the aforementioned facts of the case, submission of counsel for the parties, nature of reliefs prayed for during course of arguments and considering that the proceedings is still pending before the Respondent No. 2/Collector pursuant to the show-cause notice issued to the petitioner, I find it appropriate to dispose of this writ petition directing the Respondent No. 2/Collector to conclude the proceedings initiated against the petitioner in accordance with law, expeditiously, preferably within a further period of 02 months from the date of receipt of the order.
6. With the aforesaid observation and directions, this writ petition stands
