1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers :-
“1. Direct the respondents to handover the peaceful procession of free hold property situated at Land area measuring 10 Kanal, pertaining to Killa no. 39/ 14 (10-0) out of Khewat No. 73 & 79 (which are old numbers) current Khasra no of the said land is 39/14 (9-16) and Jamabadi, Khewat & Khatoni Nos are 155 / 136 & 163 respectively situated at Mauza Naya Bans, Tehsil Sampla, Distt. Rohtak, Haryana along with all rights, title and interest attached to the property. ...”
2. The petitioners are a successful auction purchasers of the property in question having paid Rs. 1,76,00,000/- and the sale certificate has been issued on 09.08.2024. 3. to enjoy the property as the same was part of winding up proceedings. 4. Mr. Manchanda, learned counsel for the respondent No. 2/ Official Liquidator, states that the possession has been handed over to the respondent bank and it is in their control. 5. The respondent bank is therefore directed to remove all fixtures and fittings and hand over the vacant and peaceful possession of the property in question within 6 weeks from today, failing which the respondent shall be liable to pay damages for unauthorized use and occupation of the premises in question to the petitioners at the rate of Rs. 5,000/- per day. 6. Mr. Roy, learned counsel for the petitioners, states that similar premises will fetch a monthly rental of Rs. 1.75 Lakhs to Rs. 2 Lakhs. Hence, rate of Rs. 5,000/- is being fixed. 7.
In case the respondents are unable to sell the plant and machinery lying at the premises, the respondents may remove the same and store it in a warehouse. 8.
