Prayer in the instant petition filed under Section 528 of BNSS, 2023 is for issuance of direction to respondents No.2 to 5 for registration of FIR on the complaint dated 07.10.2024, given by the petitioner against private respondents No.6 to 11 for solemnizing the marriage of respondent No.6 with respondent No.7 without taking divorce from the petitioner and threatening to kill him and his family members, with further prayer for issuance of direction to respondent No.5 to take action on the representation dated 07.10.2021 (Annexure P-1). At page No.34 of the paper book, report of SHO, Police Station Barara, dated 26.10.2024 has been placed on record, perusal of which reveals that during investigation of this complaint, SI Shish Pal of Police Post Barara conducted the investigation and during the investigation, respondent Sandhya Sharma wife of Sunil Kumar daughter of Naresh KOMAL 2025.08.08 18:20 I attest to the accuracy of this document
CRM-M-27759-2025 (O&M) -2- Kumar, resident of Village Saran, Police Station Chhappar, District Yamuna Nagar stated in her statement that she was living in a live-in relationship with Sushil Kumar son of Chander Lal, resident of Labkari of her own free will. She had not married with Sushil Kumar. It was found from the investigation of the complaint that respondent Sandhya Sharma wife of Sunil Kumar daugher of Naresh Kumar, resident of village Saran, District Yamuna Nagar is living in a live-in relationship with Sushil Kumar son of Chander Lal, resident of Labkari, Tehsil Indri, District Karnal of her own free will. No one had arranged Sandhya Sharma's marriage with Sushil Kumar, nor had the complainant been able to present any proof of the marriage and the said complaint was filed. Keeping in view of the aforesaid report, no further order is required to be passed and the present petition is disposed of accordingly. However, the petitioner is at liberty to avail the efficacious lawful remedy available to him. (SUKHVINDER KAUR) JUDGE
