“10.1 That, this Hon'ble Court may kindly be pleased to call for records with respect to rationalization of Schools in question; 10.2 That, this Hon'ble Court may kindly be pleased quash /set-aside the impugned order dated 27.05.2025 passed by the respondent Under Secretary, School Education Department whereby the "Govt. Primary SchoolRangepara (UDISE Code 22041629704), Distt.- Sarangarh-Bilaigarh" has been wrongly merged with
"Government Primary School, Sahaspur (UDISE Code 22041618301) Distt.-Sarangarh-Bilaigarh", under rationalization policy dated 02.08.2024 mentioned at serial No.320; 10.3 That, this Hon'ble Court may kindly be pleased to direct the respondent authorities to permit and allow, these schools to run within their existing building and premises respectively, as earlier; 10.4 That this Hon'ble Court may kindly be pleased to grant any other writ/ writs, order/ orders, relief/ reliefs in favor of the petitioners, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case.”. 2. Grievance of petitioners are that two schools i.e. Government Primary School Sahaspur and Government Primary School Rangepara has been merged in view of rationalization policy formulated by the State Government.
He submits that merger of two schools with distance beyond 500 meters is contrary to the earlier policy of the State Government. 3. Learned State counsel submits that according to the written instructions received from the concerned District Education Officer, Sarangarh – Bilaigarh after receipt of report that two schools having
3 distance of more than 500 meters has been merged, Collector has taken initiatives and has directed for separating the said schools and now both the schools are separately running. 4. At this stage, learned counsel for petitioners submits that in view of the submission made by learned State counsel, petitioners who were earlier posted at Government Primary School, Rangepara, therefore, petitioners may be re-posted in same school. 5. This writ petition is filed under WPC. The main grievance of petitioners are with regard to merger of two schools, which in view of submission made by learned State counsel based on written instruction received from District Education Officer and placed before this Court, the said grievance of petitioners has been redressed. With respect to other submission made by learned counsel for petitioners for re-posting of the petitioners in the same school, petitioners if aggrieved may file appropriate proceedings. 6. In view of the aforementioned facts of the case, this writ petition at this stage is disposed of reserving liberty with petitioners to file appropriate proceedings for other grievance raised, if they so desire.
