1. This hearing has been done through hybrid mode. 2. By the way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereafter referred to as ‘BNSS’), the petitioner is seeking quashing of FIR No. 74/2023, registered at Police Station Krishna Nagar, Delhi, for the offences punishable under Sections 498A/406/323/506 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. This is a digitally signed order. 4. The petitioners and respondents no. 2 are present before this Court and have been identified by their counsel and Investigating Officer. 5. Briefly stated, the marriage between Petitioner No.1 and Respondent No.2 was solemnized on 19.10.2019 in accordance with Muslim rites and ceremonies. Owing to matrimonial discord and temperamental differences, the parties started residing separately with effect from 16.07.2021. Thereafter, Respondent No.2 lodged several cases against the Petitioners. During the pendency of proceedings, with the intervention of family members and other respectable persons, the parties amicably resolved all their disputes before the Mediation Cell, Karkardooma Courts, Delhi, and executed a Memorandum of Understanding dated 08.08.2024. 6. On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement vide Settlement Agreement dated 08.08.2024, out of her own free will, without any force, coercion or undue influence.
She further states that the entire settled amount has been received by her and that she has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all proceedings emanating therefrom are quashed. 7. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8. Accordingly, FIR No. 74/2023, registered at Police Station Krishna Nagar, Delhi, for the offences punishable under Sections 498A/406/323/506 This is a digitally signed order.
