Through this anticipatory bail application, filed under Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, apprehending his arrest in connection with Tatanagar Police Station Case No.39 of 2023 for allegedly committing offences under Sections 307, 120-B, 34 of the Indian Penal Code and Sections 25(1-b)a, 27, 35 of the Arms Act, pending in the Court of the Railway Judicial Magistrate, Chakradharpur, has prayed for grant of anticipatory bail.

Learned counsel for the petitioner submitted that the petitioner is absolutely innocent and has been falsely implicated in this case. He submitted that the informant has lodged the present case being Tatanagar Police Station Case No.39 of 2023, as a counterblast of the case instituted by the petitioner against the informant being Tata Nagar Police Station Case No.36 of 2023. He also contended that the petitioner has falsely been implicated in this case as the petitioner happens to be the maternal uncle of one Vishal Singh, who is alleged to have fired upon the informant. He argued that no specific allegation has been averred against the petitioner. He lastly submitted that co-accused Aman Singh has been granted bail by the Trial Court. 4. Learned A.P.P. appearing for the State opposed the prayer for anticipatory bail of the petitioner. He submits that in course of investigation police has collected materials showing involvement of the petitioner in the crime. 5. First Information Report being Tatanagar Police Station Case 39 of 2023 was instituted on the basis of the fardbayan of Aman Tiwary, wherein he has alleged that informant alongwith Niraj Dubey, Asif Ali, Md. Jahid, Vinay Kumar Pandey, Sourabh Singh and Sachin Tiwary were gossiping at the counter of Railway Parking when Niraj Dubey received a call from Aman
2025:JHHC:16244 -: 2 :- Mishra and thereafter they moved towards Railway Platform. While they had moved 15-20 meters, he heard a voice “Vishal Goli Chalao” and Vishal Singh opened fire on Niraj Dubey from beside a tempo parked there. It was seen that Niraj Dubey was bleeding from the left side of his neck and beneath the elbow of his right hand. Injured Niraj Dubey was taken to T.M.H. The reason for assault has been alleged to be a prior incident on 15.05.2023. It has been alleged that on the instigation of this petitioner and in connivance with Golu Yadav, Sintu Singh and with the help of Sikandar, accused persons Vishal Singh, Ashutosh Singh, Raja Singh @ Raja Pagla and another unknown have committed the offence. 6. From the allegation, I find that the informant has indicated involvement of this petitioner in the crime. In the case diary also, there are materials to show involvement of the petitioner. From the case diary I find that inspite of several attempts made by the police, petitioner is evading his arrest.
Considering all these materials, I am not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for grant of anticipatory bail to the petitioner is hereby rejected. 7. This anticipatory bail application is, accordingly, dismissed. (Ananda Sen, J.) Kumar/Cp-03
