This writ petition has been filed challenging the order dated 16.09.2025 passed in Civil Suit Class-A/48/2025 whereby the learned Civil Judge Senior Division, Kasdol District – Balodabazar – Bhatapara (CG) has rejected the application under Order 39 Rule 3 of the CPC for grant of ex parte injunction. This Court while issuing notices to the respondents on 26.09.2025, directed that status quo with respect to the suit property of the civil suit be maintained by the respective parties. 3. Learned counsel for the parties submit that the application filed by the petitioners/plaintiffs under Order 39 Rule 1 & 2 of CPC is till pending consideration. Therefore, this writ petition may be disposed of with a direction to the learned Civil Judge to take a decision on the application under Order 39 Rule 1 & 2 expeditiously and till then the interim order granted by this Court on 26.09.2025 may be continued. 4. In view of the submissions made at the bar, this writ petition is disposed of and it is expected that learned Civil Judge Senior Division, Kasdol shall decide the application under Order 39 Rule 1 & 2 of CPC pending before it expeditiously with the cooperation of the parties. Till decision of the said application, the interim order dated 26.09.20525 shall remain in operation. 5. With the above observations, the writ petition stands disposed of.
